Over the years, we’ve heard many couples saying that creating prenups take the fun out of your Palm Beach wedding. Well, we are here to tell you that is absolutely not the case! It may not be a fun topic like floral or décor, but it is so important.
As the average age of couples getting married increases, so do the assets couples bring into the marriage. Some of you may already be established in your careers, have investments, and even have purchased property. Creating a prenup gives you security knowing that what you are bringing into the marriage stays with you if you leave it.

1. Not Just for the Wealthy
First things first, anyone can get a prenuptial agreement. It’s not just for the uber wealthy or family dynasties! They are for anyone who is coming into a marriage with assets. The types of assets can vary, but you still want to protect what you are bringing into the marriage.
2. Think of it as Insurance
You insure big purchases in your life (home, car, jewelry, etc), think of a prenup as the insurance of your marriage. It is a safety net that you put into place in case anything happens. There is no harm in having it there if you don’t need it, but it is essential if you do need it.
3. What You’ll Need to Prepare
When meeting with an attorney like Angela Prudenti of Sachs Sax Caplan, you will need to come prepared with lists of each of your premarital assets. This can include investments, 401ks, vehicles, properties, etc. Even if you are unsure if something would be considered an asset, bring the information along. Best to discuss directly with your attorney.
4. It Will Take Time
Please keep in mind that if you are wanting to have a prenup, it can take time to complete. Coming to a mutual agreement about the terms and conditions can sometimes take several weeks or months. So don’t wait until the last minute! Starting the process earlier rather than later is best.
Also, be warned…if you decide to spring a last minute prenup on your fiancé and later have to enforce the agreement in court, often times a Florida judge will not enforce the agreement. The prenup can be seen as being obtained under “fraud, duress, coercion, or overreaching” and that goes against Florida law.
5. Both Have to Agree
Prenuptial agreements need to be agreed upon by both of you, which is why it can take time to complete. Florida law clearly states that the prenup is “not enforceable” if one spouse can prove the other obtained consent thought “fraud, duress, coercion, or overreaching.”
